These Terms and Conditions ("Terms") govern the access to and use of the food delivery platform, including the website, mobile application, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.
1. Definitions
Platform: The food delivery application, website, and all related services.
Company / We / Us / Our: The legal entity operating the Platform.
User / You: Any individual or entity using the Platform, including customers and restaurants.
Customer: A user placing orders for food or beverages through the Platform.
Restaurant / Partner: Any restaurant, food business, or merchant offering products via the Platform.
Order: A request made by a Customer through the Platform for food or beverages.
2. Scope of the Platform
The Platform acts as an intermediary between Customers and Restaurants. The Company does not prepare, cook, store, or deliver food unless explicitly stated otherwise. Restaurants are solely responsible for the preparation, quality, safety, and accuracy of their menu items.
3. Eligibility
To use the Platform:
You must be at least 18 years old or have legal capacity under applicable law.
You must provide accurate, complete, and up-to-date information.
You agree not to use the Platform for unlawful or fraudulent purposes.
The Company reserves the right to refuse or terminate access at its discretion.
4. Account Registration
4.1 Customer Accounts
Customers may be required to create an account to place orders. You are responsible for maintaining the confidentiality of your login credentials.
4.2 Restaurant Accounts
Restaurants must provide valid business registration details, banking information, and comply with all applicable food safety and local regulations.
The Company may verify information and suspend or terminate accounts if false or misleading information is provided.
5. Orders and Payments
5.1 Placing Orders
Orders placed through the Platform constitute a binding agreement between the Customer and the Restaurant.
5.2 Prices
Prices are set by the Restaurants. The Company is not responsible for pricing errors.
5.3 Payments
Payments are processed through third-party payment providers. The Company does not store full payment card details.
5.4 Cancellations & Refunds
Cancellation and refund eligibility depend on the status of the order and the Restaurant’s policy. Once food preparation has started, refunds may not be possible.
6. Delivery
Delivery times are estimates only. Delays may occur due to traffic, weather, restaurant delays, or force majeure events. The Company is not liable for late deliveries beyond reasonable control.
Risk of loss transfers to the Customer upon delivery.
7. Responsibilities of Restaurants
Restaurants agree to:
Comply with all food safety, hygiene, and health regulations.
Ensure accurate menu descriptions and pricing.
Fulfill orders in a timely and professional manner.
Handle allergens and dietary information responsibly.
The Company is not liable for food quality, allergens, or health-related issues.
8. User Conduct
Users must not:
Misuse the Platform
Harass or abuse restaurants, drivers, or staff
Submit false reviews or ratings
Attempt to hack, disrupt, or reverse engineer the Platform
Violation may result in account suspension or termination.
9. Reviews and Content
Users may submit reviews, ratings, and feedback. By submitting content, you grant the Company a non-exclusive, royalty-free license to use, display, and distribute such content.
The Company reserves the right to remove content deemed inappropriate, misleading, or offensive.
10. Fees and Commissions (Restaurants)
Restaurants agree to pay commissions or service fees as agreed separately. Failure to pay may result in suspension or termination.
11. Intellectual Property
All intellectual property related to the Platform, including logos, software, and content, belongs to the Company or its licensors. Unauthorized use is prohibited.
12. Privacy
Personal data is processed in accordance with our Privacy Policy. By using the Platform, you consent to such processing.
13. Limitation of Liability
To the maximum extent permitted by law:
The Company is not liable for indirect, incidental, or consequential damages.
The Company is not responsible for acts or omissions of Restaurants or delivery partners.
Liability is limited to the amount paid by the User for the specific order.
14. Indemnification
You agree to indemnify and hold harmless the Company from claims arising from your use of the Platform, violation of these Terms, or applicable laws.
15. Force Majeure
The Company is not liable for failure or delay caused by events beyond reasonable control, including natural disasters, strikes, system failures, or government actions.
16. Termination
The Company may suspend or terminate access to the Platform at any time without prior notice if these Terms are violated.
17. Changes to Terms
The Company may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction where the Company is registered, unless mandatory law provides otherwise.
